Please note that this Privacy Statement does not apply to data processing carried out by or through third-party web pages linked to this website, as we have no influence or control over their configuration and content.   1. Who are the Joint Data Controllers and how to contact them?

The Joint Data Controllers of the processing of your personal data carried out through this site are:

You can contact each of the Contributors by ordinary mail, by writing to the address of their respective registered offices, or by email, at privacy@temakinho.com.

  1. Which categories of personal data do we process? And what methods do we use to process them?

What personal data we collect and how we collect it depends on the products you purchase or the services you request, and how you interacted with Temakinho. In some cases, we can receive them from third parties, if you have given these subjects the consent to share them.

In particular, in the website we process the following categories of personal data:

- contact details: name, surname, address, phone number, email address;

- other personal details: date of birth, gender, data on your educational, professional and work experience background and, more generally, the data contained in your CV, covering letter, accompanying email that you send us;

- the information you would like to freely communicate to us by contacting us through our dedicated channels: “Contact us”, “Banqueting & Events”, “Jobs”, “Book a table”;

- payment details: financial information about your credit card or prepaid card if you choose these payment methods for our products or services;

- data from cookies, web beacons, and other similar technologies. For more details, please see our cookie policy.

Your data may be processed with manual or IT tools, able to ensure security, confidentiality, and prevent unauthorised access.

If you provide us with personal data on someone else's behalf, you must first ensure that the Data Subjects have read this Privacy Statement.

We ask you to help us to keep your personal data up to date, informing us of any changes that may occur and we ask you not to include in your messages to us personal data concerning third parties or 'sensitive' data (meaning those that could reveal your racial or ethnic origin, your political opinions, religious or philosophical beliefs, your trade union membership, your genetic, biometric or health data, or data about your sex life or sexual orientation). Should you send such data, we will delete this information.

We collect your personal data when you:

  • purchase one of our products in the 'Shop' area of our website or request our service (such as table reservations or catering services at home or at specific restaurants or locations you have chosen, through section “Book a table” and “Banqueting & Events”);
  • contact us to send us your application for job offers (section “Jobs”) or to send us or request information or details or request support through our communication channels (section “Contact us”);
  • subscribe to newsletters;
  • browse on our site. For this, we use cookies (small text files that are installed on your browser) and other techniques such as web beacons (small image files). For more details, including how to disable them, please see our cookie

 

  1. For what purposes can we process your data? What is the legal basis for each of these purposes? And what happens if you don't give us your data?

The processing of personal data must be legitimised by one of the legal requirements (so-called 'legal basis') provided by current data protection legislation, as described below:

  1. purposes related to the reservation of the table in the establishment, day and time preferred through the 'Book a table' section: pre-contractual purposes (when choosing the establishment, choice of the preferred date and time, specification of the number of persons and, if necessary, payment of a deposit). Legal basis of the processing: implementation of pre-contractual measures. The communication of your data is optional but necessary to achieve these purposes: Therefore, if you do not provide us with your data, you will not be able to use the table booking service;
  2. purposes connected with the provision of the services requested, i.e. the purchase of products online in the 'Shop' section of our website, the management of the relative purchase orders, payments, invoices and shipments, as well as the fulfilment of the legal obligations deriving from them (e.g. in accounting and tax matters). Legal basis of processing: pre-contractual purposes (when identifying and selecting the products to be purchased), contractual purposes (following the purchase and concerning the purchase, payment, invoicing, shipping, delivery, and after-sales service) and fulfilment of specific legal obligations (for example, administrative-accounting purposes). The communication of your data is optional but necessary to achieve these purposes: therefore, any refusal to provide such data would make it impossible to buy our products online;
  3. the supply and request for our catering services at home or at specific restaurants or locations specified by you in writing to the email address events@temakinho.com or on the appropriate form of the 'Banqueting & Events' section of our website, as well as fulfilment of the legal obligations deriving from them (e.g. in accounting and tax matters). Legal basis of the processing: pre-contractual purposes (when you make the request for the catering and restaurant service, and our offer of the relative services), contractual purposes (following the request, supply of the service, management of the same, payment and/or invoicing through advance bank transfer or payment of deposit directly to the restaurant you have chosen) and fulfilment of specific legal obligations (for example, administrative-accounting purposes). The communication of your data is optional but necessary to achieve these purposes: therefore, any refusal to provide such data would make it impossible to carry out those activities;
  4. the purpose of sending your curriculum and/or your covering letter to the email address job@temakinho.com or on the form provided in the 'Jobs' section of our website, as part of the research, selection and assessment of candidates with a view to initiating an employment relationship with one of the Joint Data Holders. Legal basis of the processing: performance of the pre-contractual measures (to facilitate the conclusion of the employment contract). The communication of your data is optional but necessary to achieve these purposes: therefore, if you do not provide us with your data, you will not be able to use the procedures to send your CV and/or covering letter by email;
  5. allow you to contact us through the 'Contact us' section of our website and to us to answer you. Legal basis of the processing: our legitimate interest in responding to your communications. Processing for this purpose is not mandatory, and you can oppose it in the manner referred to in paragraph 9 below. In the latter case, we will not be able to process your personal data for this purpose, unless we can prove that there are overriding legitimate reasons;
  6. sending of newsletters, containing news or information, initiatives and activities, carried out using remote communication tools (such as email). Legal basis of the processing: your express consent; failure to provide the same does not have consequences for contractual relationships. You can always withdraw consent as per paragraph 9. In the absence of consent or the event of its withdrawal, commercial communications will not be sent;
  7. offer online advertising and sending commercial communications based on your interests through the use of cookies. Legal basis of the processing: your express consent; failure to provide the same does not have consequences for contractual relationships. If you have not given your consent or have subsequently withdrawn it, we will not be able to offer online advertising and/or proceed with the above commercial communications via cookies.   8. performance of activities functional to any sales of companies and business units, acquisitions, mergers, demergers, transformations, and the performance of such operations. Legal basis of the processing: our legitimate interest in carrying out such operations. Processing for this purpose is not mandatory and you can oppose it in the manner referred to in paragraph 9 below. In the latter case, we will not be able to process your personal data for this purpose, unless we can show that there are overriding legitimate reasons;
  9. fulfilment of legal obligations or orders of public authorities, concerning, and based on, the data you provide for the pursuit of the above purposes. Legal basis of the processing: fulfilment of a legal obligation. If you do not provide us with your data, we will not be able to carry out the main purpose (among those listed above) for which your data have been requested;
  10. to defend our rights before the judicial authorities. Legal basis of the processing: our legitimate interest in asserting and defending our rights. Processing for this purpose is not mandatory, and you can oppose it in the manner referred to in paragraph 9 below. In the latter case, we will not be able to process your personal data for this purpose, unless we can prove that there are overriding legitimate reasons.

 

  1. What is the main content of the existing joint ownership agreement between the Data Controller?

Under the Joint Ownership Agreement between the Joint Data Controllers and concerning the processing of your personal data through this section of this website, Temakinho carries out, each for its geographical area, processing related to:

- table reservation through the 'Book a table' section of our site;

- supply and demand for our catering services at home or at specific restaurants or locations you identify;

- research, selection and assessment of candidates with a view to the possible establishment of an employment relationship with one of the Joint Data Controllers;

- offer online advertising and sending commercial communications based on your interests through the use of cookies.

- performance of activities functional to any sales of companies and business units, acquisitions, mergers, demergers, transformations, and the performance of such operations.

- fulfilment of legal obligations or orders of public authorities,

- defence of our rights before the judicial authorities.

Temakinho exclusively carries out processing related to:

- the purchase of our products in the 'Shop' section of our website.

- your ability to contact us through the 'Contact us' section of our website;

- sending of newsletter.

It is understood that each of the Joint Data Controllers undertakes to comply with the applicable data protection legislation and is liable for any violations attributable to it.

  1. To whom may we disclose your data?

Except for cookies as specified in the cookie policy, for the pursuit of each of the purposes referred to in paragraph 4 above, your personal data collected through this site may be disclosed to the following categories of subjects:

  1. our employees specifically assigned to process your data, in particular customer service online and in our restaurants, sales staff, accounting, human resources, IT, marketing, and, in general, our duly appointed employees and employees in our restaurants;
  2. our employees to provide the requested catering service and to provide you with assistance;
  3. providers of legal advice and assistance services;
  4. providers of IT services including software support, or archiving;
  5. any company used to provide us with a service (e.g. logistics services for the delivery of purchased products, and companies used to provide a home catering service, on our behalf, or at specific restaurants or locations you have chosen)
  6. the police, government agencies, regulatory bodies, courts or other public authorities authorised by law;
  7. third parties or bodies to which the communication of data is required by law.
  8. subjects who are transferees of a business or branch of a business, potential purchasers of one of the Joint Data Controllers and companies involved in, or resulting from, any mergers, demergers or transformations.

The subjects mentioned above may act, depending on the case, as data controllers or autonomous data controllers. Other than to these subjects, your data will not be disclosed.

  1. We transfer your data outside the European Union and the European Economic Area?

For the performance of our services, we also transfer your data to service providers located in the United States and in Canada.

The transfer of your data to this country takes place in any case in compliance with the applicable regulations and international treaties. In particular, the suppliers to whom we transfer your data have subscribed to the so-called 'Privacy Shield' (https://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/5306161), those in Canada have subscribed to the so-called 'Canadian Act' (https://www.garanteprivacy.it/web/guest/home/docweb/-/docweb-display/docweb/1401637).

You have the right to obtain a copy of the data held abroad and to obtain information on the place where such data are kept by expressly requesting it from us at the addresses indicated in paragraph 1 above.

  1. How long do we retain your data?

Except for cookies as specified in the cookie policy, we store your data for different periods depending on the purposes for which you have communicated them to us. More precisely:

  1. to allow you to book your table online at one of our restaurants: we retain your data until the day of your requested table booking and, for the sole purpose of protecting our rights in the event of disputes, for the next 10 years, unless retention for a longer period is required for any disputes, requests by the competent authority or under applicable law;
  2. to allow you to purchase our products online: we retain your data from the day of purchase and for the next 10 years, except in cases where retention for a longer period is required for any disputes, requests from the competent authority or under applicable law;
  3. to allow you to request our catering services at home, or at specific restaurants or locations identified by you: we retain your data from the day of purchase and for the next 10 years, except in cases where retention for a longer period is required for any disputes, requests from the competent authority or under applicable law;
  4. so that you can send us your CV and/or covering letter: for 12 months from the day you sent us these documents;
  5. allow you to contact us through the 'Contact us' section of our website: for six months from the day you sent us your request;
  6. for sending our newsletter: for 24 months including the day you gave us your details;
  7. to offer online advertising and to send with commercial communications based on your interests through the use of cookies and, more generally, for the data collected through cookies: we encourage you to read our cookie policy;
  8. solely to defend and assert our rights also before the judicial authorities: from the day you provided us with your data, for the next 10 years, unless retention for a longer period is required for any disputes, requests by the competent authority or under applicable law;
  9. to comply with legal obligations or orders from public authorities: for as long as the legislation in force allows;
  10. for the performance of activities functional to any sales of companies and business units, and to extraordinary operations (such as acquisitions, mergers, etc.): the retention periods indicated above shall apply according to the corresponding purpose concretely pursued.

 

  1. What are your rights concerning the processing of your personal data?

We guarantee that you can exercise your rights under Article 12.2 of EU Regulation No. 679/2016 (so-called 'GDPR') at any time. In particular, you have the right to:

- to have access to your data;

- request the rectification of your inaccurate personal data or the integration of incomplete data;

- obtain the erasure of your personal data in the presence of one of the reasons envisaged by the GDPR; 

- request to limit the processing only to specific personal data, if one of the reasons provided for in the Regulation occurs; 

- if we process your personal data using automated systems based on your consent or a contract, to request to receive your personal data in a structured, commonly used and readable format from an automatic device or to request their transmission to another data controller without hindrance;

- object in whole or in part to the processing of your personal data; 

- withdraw your consent to the processing at any time if it is based on consent, without prejudice to the lawfulness of the corresponding processing until the time of withdrawal.

You can exercise these rights by sending us the appropriate communication at the addresses indicated in paragraph 1 above.
